The Honorable Chairperson
Law Commission, Government of India.
Respected Sirs,
Subject: APPEAL FOR ADDITIONAL JURY PANELS -Regarding
We are writing to draw your attention to the pervasive issue of an extensive backlog of crores of cases in Indian courts, leading to protracted delays in the delivery of justice. We propose the creation of required number of Additional Jury Panels in every court through a simple selection process as a strategic solution to address this critical concern.
Implementing Additional Jury Panels comprising of 3 - 5 lawyers in a panel would not only expedite the resolution of crores of pending cases but also provide a valuable source of legal earnings for many lawyers currently facing financial challenges. The simple selection process with strict guidelines and supervision to lawyer candidates as to be not involved in corruption with litigants which would disqualify their legal profession would enable swift inclusion, fostering a diverse and capable pool of legal professionals to contribute to the justice system.
The prolonged legal battles citizens face, waiting for years or even decades for a resolution, have severe consequences on their lives. This delay has unfortunately given rise to unauthorized or black courts of goondas / bad miscreants undermining the integrity of our legal system. Establishing Additional Jury Panels would counteract this trend, instilling confidence in the rule of law and reducing the prevalence of illegal, immoral and cruel practices.
We earnestly request the government to consider this proposal seriously, recognizing its potential to bring about positive change. Swift justice not only upholds the principles of fairness but also alleviates the burden on individuals navigating the legal system. The additional burden of payments to lawyers in jury panels might be partially or fully be compensated by the fees from the parties who opted for speedy redresses of their litigations.
Implementing this approach would not only expedite the resolution of pending cases of more than 5 crores for years and decades in Indian courts but also promote transparency and fairness in the legal process. Additionally, it would provide opportunities for more lawyers to actively participate in the administration of justice, contributing to the overall improvement of the legal system.
In conclusion, addressing the issue of delayed justice through the establishment of Additional Jury Panels is not just a legal imperative but also a means to provide economic support to struggling lawyers. We trust that your office will consider this proposal with the urgency it deserves, ultimately benefiting both the legal fraternity and the citizens seeking timely resolution. DELAYED JUSTICE IS NOT ONLY DENIED JUSTICE BUT IT IS ALSO CERTAINLY FAILURE OF JUDICIARY.
Thank you for your attention to this crucial matter.
Sincerely,
Abimani Chandrasekaran
